These Terms govern your use of Mapfolio (“Service”, “we”, “us”), operated by Daniel Arnarsson, a sole proprietor in Japan trading as “Mapfolio” (“Mapfolio”). By creating an account or using the Service, you (“Customer”, “you”) agree to these Terms.
1. The Service
Mapfolio offers two products:
- Mapfolio for Agents — a software-as-a-service tool that helps real estate professionals build property shortlists, share interactive proposals with their clients, and analyse the resulting engagement, on a subscription plan.
- Mapfolio — a consumer tool for an individual to map, compare, and check commutes for the homes they are considering, offered as a free tier plus an optional one-time, non-renewing Mapfolio Plus access pass.
Features and limits depend on your product and plan, described at mapfolio.co/#pricing. References to a “subscription” in these Terms apply to Mapfolio for Agents; provisions specific to the consumer Mapfolio product are called out where relevant.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract. You are responsible for all activity on your account, for keeping credentials secure, and for the actions of any team members you invite. Notify us immediately at [email protected] if you suspect unauthorised access.
3. Customer Content
“Customer Content” means everything you upload, create, or transmit through the Service: property listings, photos, addresses, notes, client information, and any data your end-clients (the people you share proposals with, “End-Clients”) submit while interacting with shared shortlists.
- You retain all rights in Customer Content.
- You grant Mapfolio a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, display, and process Customer Content solely to operate, maintain, secure, and improve the Service for you.
- You represent that you have the right to upload Customer Content and to share End-Client information through the Service in accordance with applicable law (see Privacy Policy).
- You will not upload content that is unlawful, infringing, defamatory, or that you do not have permission to share.
4. Acceptable use
You will not, and will not allow others to:
- reverse engineer, scrape, or copy the Service except as permitted by law;
- use the Service to send spam or unsolicited messages;
- interfere with the Service’s operation or security;
- build a competing product using the Service;
- use the Service in violation of export, sanctions, or other applicable laws;
- abuse rate limits or third-party APIs accessed through the Service.
5. Plans, trials, and payment
- Trial (Mapfolio for Agents). New paid Mapfolio for Agents subscriptions begin with a 14-day trial. You will not be charged during the trial. At the end of the trial, your subscription auto-renews and your payment method is charged unless you cancel before the trial ends.
- Subscription fees (Mapfolio for Agents). Fees are billed in advance, monthly or annually, per the plan you select. Prices are listed at mapfolio.co/#pricing and may change on at least 30 days’ notice for renewals.
- Mapfolio (consumer). Mapfolio is offered as a free tier (no trial) plus an optional Mapfolio Plus access pass that unlocks additional features for a fixed period (currently 90 days), priced as shown at mapfolio.co/#pricing. The pass is a single, one-time charge that does not auto-renew; when it expires, access reverts to the free tier unless you choose to buy another pass.
- Payment processor. Payments are processed by Stripe. Your billing is subject to Stripe’s terms in addition to ours.
- Taxes. Prices are shown exclusive of tax in US dollars. Mapfolio is operated by a sole proprietor in Japan that is currently below the Japanese Consumption Tax (JCT) registration threshold and does not currently collect JCT. You are responsible for any VAT, JCT, GST, sales tax, or similar taxes that apply to your purchase. We will update these Terms if our tax-collection obligations change.
- Late payment. If a payment fails, we may suspend access until payment is made.
- Refunds. See the separate Refund Policy.
6. Third-party services
The Service uses third-party APIs (e.g., Google Maps, Navitime, Stripe, Resend, Supabase, Cloudflare). Your use of features that rely on those APIs is subject to the relevant third-party terms. We are not responsible for third-party outages or API rate limits, but we will use commercially reasonable efforts to provide alternatives where practical.
7. Beta and AI features
Some features are labelled “beta”, “preview”, or similar. They are provided as-is, may change without notice, and are not covered by any uptime commitment. Some features use machine-learning models. Outputs may be inaccurate or unsuitable for your purpose; you are responsible for reviewing them before relying on or sharing them.
8. Intellectual property
Mapfolio, including the underlying software, designs, trademarks, and documentation, is owned by us and our licensors. Except for the rights expressly granted in these Terms, no licence is granted to you.
9. Confidentiality
Each party will protect the other’s non-public information disclosed in connection with the Service using at least the care it uses for its own confidential information, and will use it only to perform under these Terms.
10. Termination
- You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
- We may suspend or terminate the Service for material breach (including non-payment), with notice where practical. We may terminate immediately for unlawful use or actions that threaten the security of the Service.
- On termination, your access ends and we will, on request received within 30 days, provide a reasonable export of your Customer Content. After 30 days, Customer Content may be deleted in line with the Privacy Policy.
11. Warranties and disclaimer
We provide the Service with commercially reasonable care and skill. Except as expressly set out in these Terms, the Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability

You will defend and indemnify Mapfolio against third-party claims arising from your Customer Content or your breach of these Terms (including misuse of End-Client data).
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-product at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of Japan, without regard to conflict-of-laws rules. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute, except that either party may seek injunctive relief in any competent court.
16. Miscellaneous
These Terms, the Privacy Policy, and the Refund Policy constitute the entire agreement between you and Mapfolio regarding the Service. If any provision is unenforceable, the rest remains in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Notices to Mapfolio go to [email protected].
